Beijing High People’s Court issues Guidelines for Determining Patent Infringement

On September 4, 2013, the Beijing High People’s Court issued new Guidelines for Determining Patent Infringement (the “Guidelines”). The Guidelines has 133 articles, covering topics such as protection scope and interpretation of claims of a patent, infringement determination and defense.  

The Guidelines is effective for patent cases before the Beijing High People’s Court, the Beijing Intermediate People’s Courts, and primary people’s courts in Haidian and Chaoyang Districts. It may also provide reference for the operation in other regions of China
