Information on Administrative Cases in Forestry to Be Disclosed as of July 1, 2014

Implementing Rules of the State Forestry Administration on Disclosing the Information on Administrative Cases of Producing and Selling Counterfeit and Shoddy Goods and Infringing Intellectual Property Rights recently issued by the Administration provide that before disclosing the information on administrative cases involving trade secret of right holders of new plant varieties, the Administration shall get the consent of those right holders. The Administration shall not disclose the said information upon the refusal of the right holders. 

 

The Implementing Rules will come into force on July 1, 2014.

 

The Implementing Rules stipulate that the State Forestry Administration shall disclose information on cases regarding the production and sales of fake seedlings and the infringement of new variety rights in forestry via its portal site. 

 

Information on such cases shall be disclosed within 20 working days after the decision of the administrative punishment. If there is any revision to the decision or cancellation of the decision due to administrative reconsideration or litigation, the State Forestry Administration shall disclose the revised information or cancellation within 20 working days after the revision or cancellation.
